Notice of Unsealing of Documents Previously Filed Under Seal

PLEASE TAKE NOTICE that, pursuant to the Bench Decision on Motion to Terminate Exclusivity; to Resume Litigation of Interdebtor Issues; and to Unseal Protected Matter, dated September 19, 2006 (the "Bench Decision"), the documents identified on the following page, which you may access by clicking the "I Accept" link, below (each of which was previously filed under seal and/or deemed to be otherwise restricted from dissemination), have been "declassified" and are now publicly available for review by clicking on one or more of the links provided on the following page (the "Declassified Documents").

PLEASE TAKE FURTHER NOTICE that, consistent with the Bench Decision, certain material in certain of the Declassified Documents has been redacted.

PLEASE TAKE FURTHER NOTICE that, with the exception of a small minority of documents authored and/or filed by the Debtors or their counsel, the Declassified Documents consist of documents and pleadings authored and/or filed by non-Debtor parties to the Resolution Process created under the Order in Aid of Confirmation dated August 4, 2006 (the "Order in Aid") and, as such, set forth the positions, assertions and views of such non-Debtor parties with respect to the issues addressed in the Resolution Process. By declassifying and making such information publicly available on the above-referenced website, the Debtors do not in any way adopt any of those views, positions or assertions nor do they make any representations as to their accuracy, defensibility or validity. The documents prepared by the Debtors and their counsel reflect a compilation of the Debtors' books and records at the time the documents were prepared. There can be no assurance that such documents were true and correct at their date or as of any subsequent date.

PLEASE TAKE FURTHER NOTICE that copies of the pre-marked Exhibits identified by the various parties to the Resolution Process (which are too voluminous to host electronically on the website) can be made available upon request in writing to counsel for the Debtors (Willkie Farr & Gallagher LLP, 787 Seventh Ave., New York, NY 10019 (Attn: Terence K.
